2. The Regulator's guide

The Information Regulator has compiled a guide, under section 10 of PAIA, on how to use the Act. It is available in each official language from the Regulator at inforegulator.org.za, and may be obtained from them directly.

3. Records we hold

We hold records in the following categories. Listing a category is not an undertaking that any particular record will be released — each request is decided on the grounds set out in the Act.

• Company records — incorporation documents, registers, resolutions.
• Financial records — accounting records, tax returns and supporting documents.
• Client records — mandates, correspondence, verification records and matter files.
• Employment records — contracts, payroll and personnel files.
• Compliance records — policies, registers and reports kept under legislation applicable to us.

Some of these are held under a statutory duty and are automatically available to the person they concern; others are subject to the mandatory grounds of refusal below.

4. Records available under other legislation

Certain records are accessible under other laws without a PAIA request — for example under the Companies Act 71 of 2008, the Labour Relations Act 66 of 1995, the Basic Conditions of Employment Act 75 of 1997, the Tax Administration Act 28 of 2011, and POPIA. Where another statute provides the route, that route should be used.

5. How to make a request

1. Complete the prescribed request form. The current form is published by the Information Regulator; we will supply a copy on request.
2. Send it to compliance@verityfin.co.za.
3. Identify the record sought with enough particularity for us to find it, and state the right you are seeking to exercise or protect and why the record is required for it.
4. Give an address and contact details, and say what form of access you want.
5. Prove your identity. If you are acting for someone else, provide proof of your authority.

We must decide within 30 days of receiving a compliant request. That period may be extended once, by not more than 30 days, where the Act allows. We will tell you if it is extended, and why.

6. Fees

A request fee and, where access is granted, an access fee are payable at the rates prescribed in the regulations. We will tell you what is payable before doing the work, and we may require a deposit where preparation will take substantial time. A requester seeking their own personal information does not pay a request fee.

7. Grounds on which access may or must be refused

Chapter 4 of Part 3 of the Act sets these out. In summary, access may be refused to protect:

• the privacy of a third party who is a natural person;
• the commercial information of a third party or of ourselves;
• information held in confidence, where disclosure would breach a duty of confidence;
• the safety of individuals, or property;
• records privileged from production in legal proceedings; and
• research information of a third party or of ourselves.

If we refuse, we will give reasons, identify the provision relied on, and tell you how to challenge the decision.

8. If you are dissatisfied

There is no internal appeal against the decision of a private body. You may complain to the Information Regulator, or apply to a court, within 180 days.
